Just because the gate was open it doesn t mean the beach is open... kind of like how you can t go into someones house just because a window was left open.



A trespassing charge is not the end of the world! Chances are when you go to court the judge will accept your defence that the gate was opened and you were not aware that the beach itself was closed. Easy enough to smooth over if you are well mannered with no prior record.

You're going to court for the trespassing not the marijuana charge according to the ticket so no they shouldn't bring that up in court. You'll probs have to pay like a 100$ fine and be done with it, the court session will probably take 10 minutes max. If this is your first time getting in trouble you could probably get the charge dismissed from your record if you hire an attorney or get a good public defender, otherwise even if it's not dismissed it could be reduced because even if trespassing isn't a huge huge deal on your record it's not great. Depends on where you're trying to go in your life, either way good luck at court and don't sweat it, that cop was cool for letting you go with the weed but a ticket for trespassing when you didn't even know the beach was closed is shittyyy

so we went in. Not even 5 minutes of being parked in a parking spot we got pulled up on by the police. We had marijuana in the car but we did not smoke it and there was a small amount of it. After they searched our car they said they would give us a break with the pot but we were assigned a court date due to us "trespassing". It doesn't say that we had the pot on the ticket he gave us but i was wondering if they'll be able to bring that up in court or not. Also how serious could this ticket be? We are both 18 by the way and have no prior record.
